Wow this is truly a refreshing event. It is really sad that this sort of thing can even happen. Like so many regulations and procedures* this is yet another clear example of abuse of authority whereby illegal activity is made legal to serve the abusers. In my opinion just reversing a wrong does not make it right - what about just compensation equivalent that really damages Monsanto - as was done to those innocents who lost much more than their lively hoods? Also those unethical judges that allow this to continue should also be included in any settlements....

MONSANTO PATENTS ASSERTED AGAINST AMERICAN FARMERS REJECTED BY PATENT OFFICE IN PUBPAT INITIATED REVIEW: PTO Finds All Claims of All Four Patents Invalid
NEW YORK - July 24, 2007 - The Public Patent Foundation (PUBPAT) announced today that the United States Patent and Trademark Office has rejected four key Monsanto patents related to genetically modified crops that PUBPAT challenged last year because the agricultural giant is using them to harass, intimidate, sue - and in some cases literally bankrupt - American farmers.
In its Office Actions rejecting each of the patents, the USPTO held that evidence submitted by PUBPAT, in addition to other prior art located by the Patent Office's Examiners, showed that Monsanto was not entitled to any of the patents.
Monsanto has filed dozens of patent infringement lawsuits asserting the four challenged patents against American farmers, many of whom are unable to hire adequate representation to defend themselves in court. The crime these farmers are accused of is nothing more than saving seed from one year's crop to replant the following year, something farmers have done since the beginning of time.
One study of the matter found that, "Monsanto has used heavy-handed investigations and ruthless prosecutions that have fundamentally changed the way many American farmers farm. The result has been nothing less than an assault on the foundations of farming practices and traditions that have endured for centuries in this country and millennia around the world, including one of the oldest, the right to save and replant crop seed."
The lawsuits filed by Monsanto against American farmers include:

Although Monsanto has the opportunity to respond to the Patent Office's rejections of the patents (U.S. Patents Nos. 5,164,316, 5,196,525, 5,322,938 and 5,352,605), third party requests for re-examination, like the ones filed by PUBPAT against the four Monsanto patents, are successful in having the reviewed patents either changed or completely revoked more than two-thirds of the time.
"We are extremely pleased that the Patent Office has agreed with us that Monsanto does not deserve these patents that it has used to unfairly bully American farmers," said Dan Ravicher, PUBPAT's Executive Director. "Hopefully, this is the beginning of the end of the harm being caused to the public by Monsanto's aggressive assertion of these patents, which threatens family farms and a diverse American food supply."

It is about time that this perversion of the patent law and others such as the extension of patent times from 20 years to 70+ years, started in the US who purports to be the defender of democracy, is finally being put in its place...

Big bully Monsanto is at it again!

Munich, May 3, 2007. In a public hearing at the board of appeal at the European Patent Office a basic patent (EP 0301749) of US company Monsanto was revoked today. Reasons were that parts of the patent were not really new and others details were not described in a way that the invention could be really repeated by other experts.
The final decision was the outcome of appeals which were filed by Canadian civil society organisation ETC Group and the European Company of Syngenta. Further oppositions were filed orginally by the NGO >No Patents on Life!< and four other companies when the patent was granted in 1994. Even Monsanto filed an opposition, but then bought the company Agracetus which originally owned the patent, withdrew its opposition and started to defend the patent.
According to Hope Shand of ETC Group, "The decision comes pretty late, 13 years after the patent was granted. But the decision to revoke the patent is wonderful news. The species wide soybean patent of Monsanto is not allowed to stand."
In its orginal version as granted the patent covered all genetically engineered plant species and especially soybeans and was seen as one of the broadest species patent ever granted on plants and seeds. The background of the so called invention was a >particle gun< method by which plants get bombarded by metallic particles and so introducing foreign genes into plant material. A similar version of the particle gun (which does not allow a precise transfer of gene sequences) is still being used today to produce not only in Monsanto´s plants.
Ruth Tippe from the organisation "No Patents on Life!" says: "This is an important step against patents on seeds, because it shows that civil society will keep on fighting and can finally succeed even against powerful multinationals."
The outcome of the procedure will not only affect Monsanto but also the European Patent Office: "It is now shown that the Patent Office is granting patents which are covering broad sectors of agricultural diversity without really invention behind. There are many others patents which simply satisfy the greed of companies but do not give benefits to society," says Christoph Then from Greenpeace.
Greenpeace which was supporting the legal challenge of No Patents on Life and ETC Group, is urging for a worldwide ban on patents on seeds and currently cooperating in a global coalition with farmers organisation (www.no-patents-on-seeds.org).

Hi Chris,
I have been reading through your website [and FAN, Sherrell, PFPC, Meier, Masters, etc.] for a few months now. I have some catching up to do!
I am a resident of Waterloo. We fluoridate, unlike surrounding Kitchener, Cambridge and Guelph with hydrofluorosilicic acid [Brenntag.is distributor, in Toronto, but they will not tell me where they get the HF]
HF is not sourced from one place Brenntag probably bids for it and obtains the best price I suspect. Further more the impurities in HF change with each batch some of which are unknown and often not checked. I will be writing about this in more detail soon. CG
A brief summary of my story, which I have incorporating into letters from communities who need help:
I am shocked. After reviewing the research literature evaluating the effects of chronic, low levels of fluoride ingestion, I realized that my low thyroid function may be caused by fluoride.
I found it difficult to believe that medical authorities would assure me of the safety of fluoride if it was known that it could harm various biological systems in our bodies.
I embarked on an experiment. I eliminated fluoride intake as much as is humanly possible. It is of course impossible to eliminate fluoride from anyone's diet, because it is found in our food, in our air that we breathe, in the water that we drink, in many drugs and anaesthesia, and in many dental products in use today [mouthwashes, toothpaste, etc.], and in tea [which I was fond of drinking].
The result of my experiment?
I no longer require thyroid hormones. Hypothyroid symptoms such as cold hands and feet are gone. My thyroid blood serum numbers have moved into "optimal" range. I am "cured" of chronic fatigue, fibromyalgia, hypothyroidism - diagnostic labels that had been applied to me over the years from various doctors.
What does fluoride have to do with the thyroid gland? Talking with thyroid experts from around the world, and reading the available research literature taught me that fluoride interferes with the body's ability to absorb iodine. Fluoride also interferes with myriad enzymes involved in the production and metabolism of thyroid hormones, both in the thyroid gland and in peripheral tissues.
Fluoride also interferes with many enzymes involved in the production of energy from carbohydrates, fats and proteins. That might partially explain the symptoms of fatigue which I experienced.
One cigarette will not kill anyone. Cigarette smoking over a lifetime may be harmful to your health or may kill you. Likewise, ingesting chronic doses of fluoride over a lifetime has the potential to do much harm.
My nieces and nephews all have dental fluorosis, a condition caused by excessive fluoride. The fluoride causes a destruction of the tooth-building cells called ameloblasts, leaving the teeth with white spots, which may, over time, become brown, mottled spots. This is due to a "hypomineralization" of teeth. [CDC 2007] They have been told that it will cost several thousand dollars to repair the damage and that these tooth veneers only last for about 10 years.

2757 Determinants of caries in adjacent fluoridated and non-fluoridated cities
A very recent 2007 study from the University of Toronto compared 2 communities in Peel region just east of Waterloo. They examined over one thousand 13 year old children from Brampton [fluoridated] and Caledon [not fluoridated]. The factors that were associated with increased cavities were; family income, the absence of dental sealants, last dental visit for check-up and cleaning, whether the child was fed infant-formula post-natally, multivitamins, and whether the child or parent was born outside Canada. As to the importance of fluoride in the rate of cavities they concluded that "The effect of fluoridation on caries in these communities was not evident".
Another recent publication [Pizzo 2007] concludes:
1) THE BENEFITS OF FLUORIDE ARE LARGELY TOPICAL NOT SYSTEMIC. They write: "it is now accepted that systemic fluoride plays a limited role in caries prevention [12, 38]." This is in agreement with the cover story article from JADA in 2000 by Featherstone and many other sources.
2) WATER FLUORIDATION MAY BE UNNECESSARY. They write: "Several studies conducted in fluoridated and nonfluoridated communities suggested that this method of delivering fluoride may be unnecessary for caries prevention, particularly in the industrialized countries where the caries level has became low. Although water fluoridation may still be a relevant public health measure in poor and disadvantaged populations, the use of topical fluoride offers an optimal opportunity to prevent caries among people living in both industrialized and developing countries." This is also in agreement with many other recent reviews and studies.
3) INTERUPTION OF WATER FLUORIDATION DOES NOT INCREASE DENTAL DECAY. They write: "In the past decades, a number of authors focused their attention on caries trend of the communities that interrupted water fluoridation in comparison to communities without water fluoridation (Kuopio and Jyvaskyla, Finland; Chemnitz and Plauen, Germany; Tiel and Culemborg, Holland; La Salud, Cuba). In these communities, during the years of water fluoridation, a caries reduction had been observed, but after the cessation, caries prevalence did not rise, remained almost the same or even decreased further. These findings do indicate that the interruption of CWF had no negative effects on caries prevalence."
4) REJECT THE NOTION THAT FLUORIDATION REDUCES SOCIAL DISPARITIES. They write: "to date, there is limited evidence to support the view that fluoridation reduced the disparities in caries." This is in agreement with the York 2000 study and a report by Locker 2001 from the University of Toronto.
I need some help here in Waterloo. I have got some Waterloo Councillors reading the research material. They are supportive. I met with the Region of Waterloo Director of Health and she is repeating what she is told to say. I have also written to a number of Dental Health officials in Ontario and Quebec. This is a global issue.
Can we help each other? I am reaching out and attempting to network with anyone who is active in this area.

Following is a plea for signing a petition in an effort to convey the gravity of the situation to the Prime Minister of India. While on surface this is an Indian issue, if not checked, it will impact all of us in the long run. Please read and sign the petition and pass out far and wide.
It should be most effective to INCLUDE SOME OF YOUR OWN COMMENTS. You could add an extra paragraph, in the area provided, expressing your own view. Here is an example of what I wrote:
"It is imperative that the reckless promotion of genetically modified foods be stopped, while I do not live in India, many of us do buy and support all traditional foods and associated industries. Contaminated foods will clearly jeopardize India's edge as the leading supplier of foods. Can India with its huge agriculture industry afford to lose its world market share along with a potential to become the leading organic food basket of the world? What if in the process, India's own food own food supply is potentially damaged or even destroyed?
Many of us have done our own investigation and found that typically the regulatory bodies all over the world are ill equipped to assess the GM conundrum and simply rubber stamp industry studies. Self serving studies - intended to expedite the regulatory process to their own end."
