This is a good example on how our hard won legislations will continue to be under attack. The pharma Mafia has never like this law and we can except these shenanigans to continue in the future. Hence it imperative that the infrastructures that were built to pass the DSHEA and other freedoms need to remain perpetually.

----------------------Do you remember HR 3377 , Dietary Supplement Access and Awareness Act (also called the "Son of Durbin" bill) from the 108th Congress? Well, it's back and they've done the "unthinkable" - they made it even worse!
US Representative Susan Davis (D-CA) has introduced HR 3156, The Dietary Supplement Access and Awareness Act, that proposes to revise the "unreasonable risk" clause of DSHEA by significantly altering FDA's burden of proving that an ingredient is unsafe for use in dietary supplements. This bill ss co-sponsored by Henry Waxman (D-CA) and John Dingell (D-MI).
This new bill is the same as one introduced in the last Congress with the addition of one new section that appears to be a direct response to a recent decision by the U.S. District Court to overturn portions of FDA's 2004 ban of ephedra (see the AHPA Update of April 14, 2005, online at: www.ahpa.org/members/update_05_0414.htm ). In that case the Court was asked to rule on FDA's use of risk-benefit analysis and on its reliance on data about one dose of ephedra to ban smaller amounts.

As a constituent and one of nearly 200 million users of dietary supplements in the United States, I am concerned about legislation such as, the so-called "Dietary Supplement Access and Awareness Act" (HR 3518) which would change the law governing vitamins, minerals, herbal and specialty products.
Over 10 years ago, the Dietary Supplement Health and Education Act (DSHEA) was passed, and I believe that it not only protects me as a consumer but allows me affordable access to safe and affordable dietary supplements.
Congress surely recognizes that there is a healthcare crisis in this country. And by supporting changes to the law that will limit the people's access to products that help keep them healthy, you're adding to it. Please don't dismantle DSHEA.
