After all the Bro-ha-ha on the FDA shenanigans, they now and then throw a crumb or two to placate the masses once placated it will be business as usual to protect their pharma cronies or should I say owners.

As usual the multitudes of safety drug toxicity issues simply escape Heath Canada (HC). Oddly, or should I say naturally, they have unlimited funds and energy to ban safe and generally effective nutrients like *Empowerplus. But both the FDA and HC will more often then not make a fuss about interaction about damaging and mostly ineffective chase cow pharmaceuticals even when they can cause death. However, they will be all over the map even for the most innocuous nutrients, especially if they are efficacious, in a blink of an eye. The fact that there are scant or non existent problems is simply ignored with trumpt up scare tactics and unreasonable demands to prove safe products safe!

This win yet again demonstrats the well choreographed pharma recipe in usurping the government and its regulatory bodies to do their dirty bidding to squelch competition from nutrients.

The total abuse of authority (bulling) against the safe effective nutrients is cleverly used on the unsuspecting.

Simply stated:

The regulatory bodies know that they, with unlimited tax payer dollars, can crush most challenges to its authority. Authority that is often based on criminal laws made legal to serve their cronies...

The small non pharma business do not have the energy and the time or money to withstand such assaults. Some that do try are totally drained by the lawyers who have a tendency to take the easy route by simply complying with Health Canada abusive directorates instead of doing their own research in dealing with such abuses.

"This is a major victory in Canada for the use of nutritional products. The trial was won on the basis of a necessity defense and due diligence."

This and the earlier Strauss Herb Company win clearly shows that these abuses, based on contrived and self serving regulations, are nothing but total scams. When challenged, by competent lawyers, they can't be upheld under the smallest scrutiny!

Judge rules Alta firm not guilty of selling bipolar pills without approval

CALGARY (CP) - An Alberta company was justified in continuing to sell a nutritional supplement to bipolar patients despite an order by Health Canada not to, a judge ruled Friday.

"The defendants were overwhelmingly compelled to disobey," said provincial court Judge Gerald Meagher as he found TrueHope Nutritional Support not guilty of selling its product without a drug identification number. "The evidence was clear and persuasive . . . if it became unavailable, those taking it regressed within a few days to aggressiveness and depression," said Meagher. "The symptoms . . . associated with bipolar rapidly returned."

"The defendant provided a vital and essential support program . . . seeking to avoid serious incapacitation or death (in the patient) due to mental illness."

TrueHope was charged under the Food and Drug Act with selling its Empowerplus pills in 2003 without federal approval. Health Canada argued TrueHope failed to provide evidence the supplement was safe and effective, but also shut down a clinical trial at the University of Calgary that could have provide that information.

TrueHope eventually received an exemption from the health minister in March 2004 and now has a natural health product number.

Hundreds of people protested on Parliament Hill after Health Canada issued its warning about the supplement. Health Canada's response was to set up a 1-800 crisis line, which advised callers to see a psychiatrist. "It should be obvious from that (decision) Health Canada realized there was a problem with removing the supplement," said Meagher.

Tony Stephan, whose wife committed suicide while suffering from bipolar disorder, approached his friend David Hardy a decade ago looking for help. His son and daughter were also bipolar and he worried their lives were at risk.

The two men developed Empowerplus pills, a concoction of 36 minerals, vitamins and antioxidants found in ordinary food and originally developed to control rage in pigs. "This is a literal godsend for us and for the many people in Canada that require the supplement to maintain mental health," said Stephan.

Stephan's daughter, Autumn Stringam, said nothing worked before she started taking the supplement. "Thirteen medications they tried on me and several hospitalizations," said Stringam, 33, who has written a book about growing up with a bipolar mother.

"I had voices, visions, ups-downs, mania, depression, a lot of suicidal thoughts. My mom had already committed suicide and my grandfather before her and I thought that is what would happen to me," she told The Canadian Press.

Now Stringam is married and has three daughters. "I need this (supplement) for my family and to continue living my normal life. It's given me a chance at a life I know I couldn't have had any other way."

Meagher said TrueHope provided a last-resort service for the most severe bipolar cases. He suggested failing to continue providing the pills could have led to further legal action against TrueHope.

"The defendant could have faced criminal prosecution for negligence if they failed to keep providing the supplement."

Both Stephan and Hardy want to see a public inquiry into Health Canada's handling of the case.

A senior official with the Canadian Mental Health Association said her group has not endorsed the product. "What we did do was ask the minister of health that research continue on the product," said Jodi Cohen, president of the group's Alberta division.

The association also pushed the government to allow people who were using the pills at the time in question to continue to get them from the United States.

An Alberta company is now free to market a vitamin and mineral supplement as a possible treatment for mental disorders.
A Calgary provincial court judge ruled Friday that Health Canada didn't give Truehope Nutritional Support Ltd. any legal alternatives to resolve a dispute over the supplement.

"Health Canada has done everything in its power to block access to Canadian people from having this. Today a precedent has been set," said Anthony Stephan, one of the co-founders of Truehope.

"This is a literally a godsend for us - and for the many people in Canada - that require this supplement to maintain mental health."
The company makes the mineral and vitamin supplement EM Powerplus and claims it can treat schizophrenia and bipolar disorder.
Health Canada has accused the company of selling the medication without a Drug Identification Number, or DIN. The makers of the medication say that it is not a drug and should not need a DIN.

Death, relapses possible: judge

In his ruling Friday, Judge Gerald Meagher said there were no indications Health Canada would even give Truehope the identification number needed. He also said taking EM Powerplus away would pose a considerable threat for the people taking the medication, including severe relapses and even death.

Stephan is calling for a public inquiry into Health Canada's actions in this case.
